Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Massage Finder USA LLC ("Massage Finder USA," "we," "us," or "our") governing your access to and use of the website located at https://www.massagefinderusa.com and all associated services (collectively, the "Platform").

By accessing or using the Platform, creating an account, or clicking "I agree" during registration, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Platform on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

To use the Platform you must:

• Be at least 18 years of age
• Be a legal resident of or authorized to conduct business in the United States
• Have the legal capacity to enter into binding contracts
• Not have been previously banned or suspended from the Platform

Therapists must additionally hold all licenses, certifications, and permits required by applicable state and local law to perform the services they advertise. By listing on the Platform, therapists represent and warrant that their credentials are valid, current, and in good standing.

You must create an account to access most features of the Platform. You agree to:

• Provide accurate, complete, and current information during registration
• Maintain and promptly update your account information
• Keep your password confidential and not share it with anyone
• Notify us immediately of any unauthorized use of your account
• Be solely responsible for all activity that occurs under your account

We reserve the right to refuse registration, cancel accounts, or remove content at our sole discretion.

Massage Finder USA is a lead generation and directory platform that connects independent massage therapists and wellness specialists with clients seeking their services.

We Do Not:

• Employ, supervise, or control the therapists listed on the Platform
• Guarantee the quality, safety, or legality of any services rendered
• Verify the accuracy of all therapist-submitted credentials (though we may review submissions)
• Participate in or supervise any session between a therapist and client
• Act as an agent or representative of any therapist or client

We are solely a technology platform facilitating connections. Any engagement, agreement, or transaction between a therapist and client is solely between those parties.

Therapists listed on Massage Finder USA are independent contractors, not employees, agents, partners, or joint venturers of Massage Finder USA LLC.

By registering as a therapist, you expressly acknowledge and agree that:

• You are operating your own independent business and are solely responsible for managing it
• You set your own prices, schedule, services, and working conditions
• Massage Finder USA does not withhold taxes on your behalf. You are solely responsible for reporting and paying all applicable federal, state, and local taxes on income earned through the Platform
• You are not entitled to any employee benefits from Massage Finder USA, including but not limited to health insurance, workers compensation, unemployment insurance, or paid leave
• You are responsible for maintaining your own professional liability insurance
• Massage Finder USA does not direct or control the manner in which you perform your services
• Nothing in these Terms creates an employment, agency, franchise, or partnership relationship between you and Massage Finder USA

If any government authority determines that any therapist is a member of Massage Finder USA, that therapist agrees to indemnify and hold Massage Finder USA harmless from any resulting liabilities, costs, or penalties.

As a therapist on the Platform, you agree to:

• Maintain all licenses and certifications required by your state and locality and keep them current
• Provide services that are legal, ethical, and within the scope of your training and credentials
• Maintain professional liability insurance adequate to cover your services
• Respond to client inquiries and booking requests in a timely and professional manner
• Honor all confirmed deposit bookings or provide adequate notice of cancellation
• Keep your profile information accurate and up to date
• Comply with all applicable health, safety, and professional standards
• Not engage in or solicit any illegal activity, including but not limited to sexual services of any kind
• Not post content that is false, misleading, defamatory, or in violation of any law

Violations of these obligations may result in immediate account suspension or termination without refund of subscription fees.

As a client on the Platform, you agree to:

• Provide accurate information when creating your account and making bookings
• Honor confirmed appointments or provide adequate notice of cancellation per the therapist's stated policy
• Treat therapists with respect and professionalism at all times
• Not solicit illegal services of any kind from therapists
• Pay all deposits and fees when due
• Leave only honest reviews based on genuine experiences
• Not attempt to manipulate the review system or post false information

The following conduct is strictly prohibited on the Platform and may result in immediate account termination and referral to law enforcement:

• Soliciting, offering, requesting, or engaging in sexual services of any kind
• Using coded language or euphemisms to suggest sexual services (including but not limited to "happy ending," "full service," "extras," or "special treatment")
• Harassment, threats, or abusive behavior toward any user
• Posting false, fraudulent, or misleading information
• Attempting to defraud other users or the Platform
• Scraping, crawling, or harvesting user data without permission
• Creating multiple accounts to evade a suspension or ban
• Interfering with the operation of the Platform or circumventing security measures
• Using the Platform for any purpose that violates applicable law

Massage Finder USA reserves the right to report any suspected illegal activity to appropriate law enforcement authorities and to cooperate fully with any investigation.

Massage Finder USA offers a Secure Deposit system that allows therapists to collect a deposit from clients before a session. By using the deposit system, you agree to the following:

For Therapists:

• We use Stripe Connect to process and collect deposits on your behalf. You will be guided through a brief onboarding process to set up your payout account during registration
• Massage Finder USA charges a platform fee of 10% of each deposit, plus applicable Stripe processing fees (2.9% + $0.30). These fees are deducted automatically before funds are transferred to your account
• You are responsible for your own tax obligations on all income received
• By marking a session as complete, you confirm the session took place and release the deposit to yourself
• Fraudulent use of the deposit system may result in account termination and legal action

For Clients:

• Deposits are held securely via Stripe until the session is confirmed complete
• Payment processing is handled entirely by Stripe. Massage Finder USA does not store your full payment card information
• Disputes about deposits must be filed through the Platform's dispute system within 7 days of the session date

Subscription fees for therapist listings are billed monthly or annually through Stripe and are subject to Stripe's terms of service. Massage Finder USA reserves the right to change subscription pricing with 30 days notice to active subscribers.

Deposit Refunds:

• Each therapist sets their own cancellation policy, which is displayed on their profile and in the deposit request. Clients are responsible for reading and understanding the policy before paying
• If a therapist cancels a confirmed booking, the client is entitled to a full refund of their deposit
• If a client cancels within the therapist's stated cancellation window (typically 24 hours), the therapist may retain the deposit
• If a client cancels outside the cancellation window, they are entitled to a full refund per the therapist's policy
• Disputes about refunds are reviewed by Massage Finder USA administration. Our decision is final
• Stripe processing fees (approximately 2.9% + $0.30) are non-refundable in all cases, as these are charged by Stripe and not recoverable by Massage Finder USA

Subscription Refunds:

• The first month of any subscription is free. No credit card charge occurs during the trial period
• Monthly subscriptions may be cancelled at any time. No refunds are issued for partial months
• Annual subscriptions may be cancelled at any time but are non-refundable after the first 30 days
• Accounts suspended or terminated for violations of these Terms are not entitled to any refund

Verified reviews on Massage Finder USA are locked to clients who completed a secure deposit booking with the therapist. By submitting a review, you represent that it is honest, accurate, and based on your genuine experience.

You agree not to:

• Post fake, incentivized, or fabricated reviews
• Post reviews for sessions that did not occur
• Use reviews to harass, defame, or threaten any person
• Post content that is obscene, discriminatory, or otherwise unlawful

By submitting any content to the Platform (including reviews, profile content, photos, and posts), you grant Massage Finder USA a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with operating the Platform. You represent that you have the right to grant this license.

We reserve the right to remove any content that violates these Terms or that we determine in our sole discretion to be harmful, false, or inappropriate.

Nothing on the Platform constitutes medical advice, diagnosis, or treatment. Massage therapy and wellness services are not substitutes for professional medical care.

Always consult a qualified healthcare provider before beginning any new wellness practice, particularly if you have a medical condition, are pregnant, or have recently undergone surgery or injury. Massage Finder USA is not responsible for any health outcomes resulting from services booked through the Platform.

Therapists may not make medical claims, diagnose conditions, or promise to cure or treat any disease or disorder. Violations of this policy will result in profile removal.

The Platform and all of its content, features, and functionality — including but not limited to the name "Massage Finder USA," logo, design, text, graphics, and software — are owned by Massage Finder USA LLC and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works from, or exploit any portion of the Platform without our express written permission. Unauthorized use may result in legal action.

Your use of the Platform is also governed by our Privacy Policy, available at https://www.massagefinderusa.com/privacy. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MASSAGE FINDER USA DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY INFORMATION ON THE PLATFORM.

WE EXPRESSLY DISCLAIM ALL LIABILITY FOR THE CONDUCT, ACTIONS, OR OMISSIONS OF ANY THERAPIST OR CLIENT ON OR OFF THE PLATFORM.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MASSAGE FINDER USA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO:

• Personal injury or property damage resulting from any session booked through the Platform
• Any unauthorized access to or use of our servers or personal information
• Any interruption or cessation of transmission to or from the Platform
• Any content obtained from the Platform
• Any transactions or interactions between users

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MASSAGE FINDER USA IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

You agree to defend, indemnify, and hold harmless Massage Finder USA LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys fees) arising out of or in any way connected with:

• Your access to or use of the Platform
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Any service you provide or receive through the Platform
• Any content you submit to the Platform
• Any claim that your content violated the rights of a third party

Between Users:

Disputes between therapists and clients regarding sessions, deposits, or refunds should first be submitted through the Platform's dispute resolution system. Massage Finder USA administration will review disputes and issue a final decision within 5 business days. Both parties agree to cooperate with this process.

Against Massage Finder USA:

Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in Broward County, Florida. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT. You may opt out of arbitration within 30 days of creating your account by sending a written notice to contact@massagefinderusa.com with the subject line "Arbitration Opt-Out."

We reserve the right to suspend or permanently terminate your account at any time, with or without notice, for any reason including but not limited to violation of these Terms, fraudulent activity, or conduct that we determine to be harmful to the Platform or its users.

Upon termination:

• Your access to the Platform will be immediately revoked
• Any pending deposits will be handled per our refund policy
• Accounts terminated for violations are not entitled to subscription refunds
• Sections of these Terms that by their nature should survive termination shall survive, including Sections 5, 13, 15, 16, 17, and 18

You may close your account at any time by contacting us at contact@massagefinderusa.com.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to personal jurisdiction in those courts.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify active users by email and post a notice on the Platform. The updated Terms will be effective immediately upon posting unless otherwise stated.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Platform and close your account.
